Terms & Conditions

Introduction:

Streamplay Solutions Pty Ltd ("Streamplay") is an Australian company (registration number ACN 616 572 144) with registered offices located at Level 5, 126 - 130 Phillip Street, Sydney, NSW 2000, Australia, which offers various bespoke cloud gaming and tournament technology services.
Streamplay has partnered with Mobibox Technologies - FZCO (" Mobibox"), based in Dubai (Trade License No. 13943) with registered offices at DSO-DDP-A5-D-FLEX-G027, Dubai Digital Park, Office A5-Dtec, DSO, Dubai, UAE, as the primary promoter and offerer of the "PlayStream" cloud gaming subscription service.
This document outlines the terms and conditions governing the use of PlayStream.

PlayStream Terms & Conditions:

Definitions
In these Terms and Conditions, the following terms shall have the meanings set forth herein:
1. "Application" means the cloud gaming application software developed by Streamplay to access the Service.
2. "Game" means any game, with or without a leaderboard, that a User can access through their Subscription.
3. "Player" means the natural person with a player profile attached to or created from a User Account, within the limits set forth herein.
4. "PlayStream" or "Service" means the online cloud gaming subscription service offered by Mobibox as defined in clause 3
5. "Subscription" means the cloud gaming service subscription against a fee and under the terms and conditions set forth herein.
6. "Terms and Conditions" means the following terms and conditions.
7. "User" means the natural person who has subscribed to the Service.
8. "User Account" means a User's personal account to which personal information related to their use of the Service is attached.
9. "Website" means the PlayStream website, accessible at www.play-stream.ca.
Purpose
1. The purpose of these Terms and Conditions is to define the terms and conditions applicable to the Service's User access.
2. These Terms and Conditions apply to the exclusion of all other terms and conditions, unless otherwise expressly agreed in writing by Streamplay. They are accessible at any time on the Website and are systematically communicated to the User upon request.
3. Any access to the Service implies acceptance of these Terms and Conditions.
Service
1. The Service consists of the provision of a catalog of short-form bespoke games which Players have access on demand, through compatible connected devices and in compliance with the Subscription's length and conditions selected by the User.
2. To ensure fair access, a queuing management system is employed. Each game within PlayStream offers a maximum gameplay session of approximately 3 minutes, promoting equitable engagement for all Players.
3. The main features of the Service and Subscriptions are presented on the Website. As part of the Service, the User has access to the following features:
  1. Creation of a User Account;
  2. Creation and management of a Player profile from the User Account;
  3. Access to all the Games available on the Website or Application;
  4. Submission of high Scores in Games linked to a Player profile; and
  5. Connection to multiple compatible devices.
4. Streamplay may, at its sole discretion, change in whole or in part the format of the Service or Games that we offer in order to enhance, correct or support such Services or Games or for any other reason.
5. It is the User's responsibility to take this into account before selecting a Subscription.
Mobibox Partnership
1. Streamplay has engaged with Mobibox, based in Dubai, to promote and manage subscriptions for the Service in collaboration with various telecom providers.
2. Mobibox will act as the primary promoter and offerer of the Service.
3. Mobibox will manage subscriptions with telecom providers as part of the promotional activities.
Your Subscription
1. The price, duration, and conditions of the Subscription are presented by Mobibox, the primary promoter and offerer of the Service. Your Subscription allows you to connect to the Service with your compatible connected devices within the limits set by the Subscription you have purchased.
Technical Prerequisites
1. By using the Service, the User acknowledges that:
  1. the installation of PlayStream as a Progressive Web App (PWA) may be necessary to enjoy access to the Service;
  2. a stable and reliable internet connection is crucial for seamless cloud gaming experiences;
  3. the quality of their PlayStream experience may be negatively affected by their chosen connection methods (including internet speed and stability), as well as factors outside of Streamplay’s control;
  4. while Bluetooth controllers like Xbox or PlayStation are supported, universal compatibility is not guaranteed, and Users should check their device's technical requirements regularly;
  5. Game availability is subject to change based on licensing agreements, updates, or other considerations; and
  6. they accept these technical and geographical prerequisites for an optimal Service experience.
Intellectual Property
1. Streamplay grants you a personal, non-exclusive, and non-transferable license during the term of your Subscription to access and play the Games available.
2. Any unauthorized use or exploitation of the Service, Games, Website, or Application, including but not limited to modification, decompilation, translation, adaptation, distribution, broadcasting, diversion, or copying of any part of the Service, Games, Website, or Application, and their constituent elements, in any manner whatsoever, is strictly prohibited without the express, written, and prior authorization of Streamplay.
Our Privacy Policy
1. To create your User account and subscribe to a Subscription, you must accept our Privacy Policy which is available on the Website.
Your Right to Cancel
1. Your Subscription can be terminated at any time by logging into your User Account. Upon termination, access to the PlayStream Service will cease on the expiration date of the current Subscription. You may re-subscribe at any time under the Terms and Conditions set forth herein.

1. For any difficulties, you may contact Mobibox via email on support@play-stream.ca.
Miscellaneous
1. If any provision of these Terms and Conditions is deemed invalid, the remaining provisions shall remain in full force and effect. Streamplay reserves the right to assign or transfer its rights and obligations under these Terms and Conditions.
2. These Terms and Conditions shall be governed by the laws of Western Australia.
